Product Terms

Pre-launch draft

1. Status and Contracting Parties

These terms are a pre-launch draft for the paid service. BeatScroll accounts and sign-in are available, but paid plans and checkout are not enabled. Before sales begin, checkout will clearly identify the seller or Merchant of Record, total price, currency, taxes, duration, and any overriding sales terms.

These Product Terms govern use of the BeatScroll service between the account holder and Marvin Jerome Stephan, trading as IT-Consulting and Design Jerome Stephan (“BeatScroll”). The Merchant of Record identified at checkout may be the seller and contracting party for payment, invoicing, tax, withdrawal, and refunds. Its terms apply in addition; mandatory consumer rights always prevail.

2. Eligibility and Account

Account holders must be at least 18 and legally capable of contracting. Anyone using BeatScroll for an organization confirms authority to act for it. Legal name, address, and privacy contact must be provided before activation. An account is for one named user and credentials may not be shared. The user may register their own devices, but only one desktop session may be live at a time.

3. Service and System Requirements

BeatScroll provides a guest link, message and reaction relay, QR material, filters, history options, and a desktop display. Supported systems are macOS 13 or newer on Intel and Apple Silicon and Windows 10 22H2 or Windows 11 on x64. A current browser, internet connection, and compatible output device are required. Features labelled “beta,” “prototype,” or “planned” are not part of a paid service commitment.

4. Access Models

Guestlist Subscription

The monthly subscription runs indefinitely. It includes one permanent editable and rotatable channel, unlimited registered devices, and one simultaneous live desktop session. Access activates after verified payment. Cancellation takes effect at the end of the paid period.

Gig Pass

A Gig Pass is one-time access for exactly 48 hours from the selected start. Its link can be viewed beforehand but remains inactive. The start can be changed until it begins and is then fixed. Scope and exact timing are shown before purchase.

5. Price, Payment, and Activation

Only the total price and currency displayed immediately before purchase apply. The final paid-order button will be unambiguous. Access activates only after verified payment confirmation. BeatScroll currently makes no commitment about price, trial, or discount.

6. Consumers, Withdrawal, and Early Performance

Consumers receive the legally required pre-contract information and withdrawal instructions on a durable medium. BeatScroll will begin performing during the withdrawal period only following a separate, unticked express request. Signing in alone is not treated as a waiver of withdrawal rights. Mandatory rights for digital products and services, including Sections 327 et seq. BGB, remain unaffected.

7. Updates, Availability, and Changes

BeatScroll provides security and functionality-preserving updates when required. Maintenance, internet disruption, DJ hardware, and third-party services may affect availability. Changes require an objective reason such as security, law, abuse prevention, or technical development and will not unreasonably prejudice users. Material adverse changes will be notified in advance with any options required by law.

8. Content and Licence

Users retain their rights in content. They grant BeatScroll only the non-exclusive rights technically needed to receive, reproduce, filter, transmit to the selected DJ app, and display content on the intended screen. Use must comply with the Acceptable Use Policy.

9. Restriction and Termination

BeatScroll may reject specific content and proportionately restrict access for security risks, non-payment, or serious or repeated rule violations. Where possible, the reason and available remedy will be explained. Either party's right to terminate for cause remains unaffected.

10. Liability

BeatScroll has unlimited liability for intent and gross negligence, injury to life, body or health, product liability, and an assumed guarantee. For slight negligence affecting an essential contractual obligation, liability is limited to damage typically foreseeable when the contract was made. Mandatory consumer and conformity rights remain unaffected.

11. Law and Venue

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protection of the law of their habitual residence. Where legally permitted, Potsdam is the agreed venue for merchants and equivalent business users.
